Online gaming and poker could be fully legalized in the US. However, politicians could try to delay the legalization and fail to focus enough on this controversial issue.There are plausible reasons to believe that at the end of the day the Unlawful Internet Gambling Enforcement Act (UIGEA) will be executed. Nevertheless, there seemed to be a slight advantage for the groups trying to regulate and legalize online gambling at the end of 2009, given the delay of the Unlawful Internet Gambling Enforcement Act and the late congressional hearings where US Congressman Barney Frank explained why online gambling should be legalized and regulated.
Much will depend on how individual states will act. Kentucky will try again to prohibit internet poker within its state by using quite dubious and so far ineffective legal action, while California factions focus on creating an intrastate structure for an individual online poker network.

Parties like in California trying to legalize internet gambling seem to understand that there is a huge market for regulated internet poker.
